Statement of Assumed Risk - Please ensure all members of your party (or their guardians in the case of under 18s) have read the following:-
The use of kayaks, canoes, paddleboards and other watercraft comes with inherent dangers that are beyond the control of TheCanoeMan/Activ-8 Adventure/Norfolk Broads Tourist Information and Activity Centre (The Provider) and its employees. Dangers include, but are not limited to capsize or falling from a watercraft, changeable weather conditions and water levels, pollution and waterborne pathogens, submerged objects and other river users. Risks involved from participation in activities organised by or through The Provider include injury, illness, damage to or loss of property or even fatality.
To minimise these risks we have evolved a "safe system of work"
Swimming abilityAll participants taking part in water activities are equipped with buoyancy aids; therefore an inability to swim will not exclude you from taking part. However, we do ask that you have a certain level of water confidence relevant to the activity in which you are participating. If you have any concerns about this please discuss it with our staff prior to booking.
Please note - under the terms of our licencing and insurance, we are not allowed to hire out craft to individuals who are paddling alone. Kayaks and SUPs may be hired individually if you are paddling with other friends/family. You will however be asked to confirm on your booking that this is the case. Canoes cannot be hired to individuals unless they can provide evidence of suitable qualifications or experience.
Your ResponsibilitiesBookings are accepted on the understanding that The Provider's safety regulations are observed by all participants.It is the responsibility of the individual who makes an activity booking to ensure that all details are correct. Particular note should be made to contact details and activity dates and times. The Provider cannot be held liable for participants missing an activity due to incorrect booking details. If an error is noticed in a booking please contact The Provider as soon as the mistake is noticed in order that it be rectified. It is the responsibility of the person making the booking to ensure that all members of their party have fully read, understood and agree to these terms and conditions. You must also ensure that you have disclosed all relevant information relating to the individuals within your party, in particular with regards to any health conditions which may be relevant to the activity being undertaken.If booking a self-guided activity (hire) on behalf of a group we ask you to consider whether your group/club or you as the organiser has any liability in the event of an accident or fatality. If so you may wish to consider allowing us to provide you with a guide/instructor at which point the liability becomes ours.
Under 12’s are not allowed on single kayaks or SUPs.
Unless otherwise stated, there is no minimum age for our activities however if your child is below 4 years old you must contact the office prior to booking to ensure appropriately sized safety equipment is available.
You cannot go on the water alone (see Lone Paddling section above).
There must be at least one adult (aged 18 year old or over) within your party.
It is your responsibility to check that the craft that you have booked are suitable for the size, ability and age of your party. The Provider will refuse launch if they feel that the craft booked are not suitable for the participants. In such instance The Provider will not be obliged to provide alternative craft or a refund (full or partial). If in doubt about the suitability of your party to specific craft, please ask prior to booking.
Guided ActivitiesWhen booking a place on a guided activity you are reserving a place on that activity and not the exclusive use of a craft. Although we endeavour to keep participants together with others from within their party, on occasions it may be necessary to split groups or for groups to share a boat with other participants.
Rearranging your Booking
If you wish to rearrange your booking for whatever reason then you will need to get in contact with us via email, at least 36 hours before the morning of your activity (for hires) and at least 7 days before the start of your activity (for guided sessions). When rearranging your booking, you will have the option of either moving your booking to a weekday outside of the summer period (17th July), free of charge or move your booking to an alternate weekend or during the summer period for a charge of £10 per boat, which is payable on the rearranged date. For guided activities, you will be able to move to an alternative activity of the same value with no additional charge, as long as you get in contact with us at least 7 days prior to the activity. In the event of wishing to rearrange a guided activity within 7 days of the activity date, please notify us in writing by email and the matter will be dealt with at the discretion of the management.
Cancellations/RefundsAll deposits are non-refundable. Refunds for cancellations will be made as follows:-
If your booking for a craft falls outside our guidelines for that craft (as stated on the website) i.e you are heavier than recommended; your child is younger than recommended or you have more people in the craft than recommended etc.We will do our best to resolve the problem but if we are unable to and you have to cancel your booking within 72 hours of the planned activity NO refunds will be made.Under certain circumstances, the management reserves the right to offer a full or partial refund if they believe the circumstances justify it.We reserve the right to alter or cancel any activity and will endeavour to give the participants as much notice as possible. In the instance of The provider cancelling your activity, you will be offered an alternative or a full refund. Where your activity had been paid for using a gift voucher the gift voucher will be revalidated.
Bad weather policy:
1. It is only deemed dangerous to be on the water in localised fork lightning or extreme high winds. In this instance we will offer the options to rebook or a refund.
2. If conditions are not deemed to be unsafe for the cancellation of activities, we will endeavour to offer the opportunity to rebook or defer the booking. Under no circumstances will a refund be made.
3. If there are exceptional circumstances, the customer may apply in writing via email for consideration for a refund.
CoronavirusIf the Government issues guidance that precludes the running of our activities, we will offer the opportunity to rearrange for a later date or alternatively issue gift vouchers to the full value of the activity. In this event, please contact us to make arrangements. No refunds will be given.
Loss or Damage or EquipmentParticipants are responsible for the care and return in good condition, as determined by The Provider, of any equipment made available to them. Participants are liable for any costs incurred by The Provider due to the equipment being returned dirty or damaged, or equipment lost or stolen whilst in their possession. The Provider is to be notified as soon as practicable of any loss or damage.
Fishing Boat Hire Fuel PolicyFishing boats with outboard motors are supplied with a full tank of fuel, enough for approximately 2 hours of continuous motoring. At the time of booking customers have the option to purchase an additional 5 litre can of fuel, the cost of which will be reimbursed if returned unopened and unused. Customers who run out of fuel and require recovery will be liable for a £40 recovery fee.
Gift VouchersAll gift vouchers non-refundable and can only be exchanged for activities provided by TheCanoeMan. They cannot be redeemed against items for sale either online or in our shop. The original gift voucher must be presented at the time of booking/payment and must be used within the expiry date. At our discretion, the expiry date may be extended for a further year but will incur an administration charge of £10 or 15% of the value of the voucher(whichever is the greater).Gift vouchers cannot be used in conjunction with any other offer/promotion.
LiabilityThe provider is not under any liability whatsoever in respect to the loss of or damage to personal property of participants, supporters, observers or bystanders where the loss or damage is not as a direct result of the negligence of The Provider.
Data Protection Act 1998The information you supply to us will only be used to process your booking and for our mailing list. If you DO NOT wish to be placed on our mailing list please advise our office staff.
PhotographyWe occasionally take photographs that may be used in future articles or advertising material, both online and in non-digital formats. If you DO NOT wish to photographed, please inform a member of staff.
